Seorang guru Sekolah Dasar harus mempertanggungjawabkan yg terbukti hanya berpura-pura meninggal.
Pengajar SD bernama Demseria Simbolon ini memalsukan surat kematiannya & selama 7 tahun tidak pernah mengajar.
Meski begitu, selama 7 tahun dia tetap mendapatkan gaji yg totalnya mencapai Rp435 juta.
WartaKotaLive melansir TribunMedan, seorang guru Sekolah Dasar Nomor 027144 Kelurahan Damai, Binjai Demseria Simbolon wajib duduk pada kursi pesakitan usai memalsukan kematiannya, pada Pengadilan Negeri (PN) Medan, Jumat (tiga/5/2019).
Terdakwa terbukti melakukan penipuan usai memalsukan kematiannya & nir mengajar selama tujuh tahun tetapi tetap menerima gaji.
“Terdakwa Demseria Simbolon yg diangkat menjadi Guru Sekolah Dasar Nomor 027144 mendapat pembayaran gaji sebesar Rp 44.901.000; tahun 2012 bisa gaji Rp 49.406.400; tahun 2013 bisa honor Rp 52.851.600; tahun 2014 bisa gaji Rp 55.621.000; tahun 2015 bisa honor Rp 58.325.700; tahun 2016 bisa honor Rp 63.805.600; tahun 2017 dapat gaji Rp 63.805.600; dan tahun 2018 dapat gaji Rp 46.326.400,” celoteh Jaksa Penuntut Umum (JPU) Asepte Ginting dihadapan Majelis Ketua Nazar Efriandi.
Ia menuturkan bahwa total honor yg diterima terdakwa dari hasil memalsukan kematiannya sebesar Rp 435.144.500.
“Jumlah seluruh honor yg diterima terdakwa Demseria menurut tahun 2011 hingga Agustus 2018 sebanyak adalah Rp 435.144.500.
Sejak Januari 2011 sampai Agustus 2018, terdakwa nir pernah masuk mengajar dan nir melaksanakan tugas sebagai guru. Namun, terdakwa tetap mendapat honor dan tunjangan,” tegas Asep.
Awal mula kasus terungkap ketika suami terdakwa Adesman Sagala mendatangi PT Taspen Persero Cabang Utama Medan, Jalan Adam Malik Nomor 64.
Dimana Ia datang bermaksud buat mengajukan penagihan pembayaran iuran pertanggungan kematian Demseria, padahal terdakwa nir tewas global.
“Setelah melakukan penelitian atas dokumen-dokumen yang dibawa sang Adesman Sagala, Muhaimin Adam selaku Pjs Kepala Seksi Penetapan Klaim pada Kantor Cabang Utama PT Taspen Medan, menyetujui dan melakukan pembayaran penagihan klaim kematian Demseria Simbolon melalui pemindahbukuan ke Rekening Bank Sumut sebanyak Rp 62.386.500 tahun 2018,” jelasnya.
Lalu, dari informasi ahli Badan Pengawas Keuangan dan Pembangunan (BPKP) Perwakilan Sumut, terdapat kerugian keuangan negara menggunakan perincian; untuk honor yg didapat (setelah dipotong pajak) sebesar Rp 311.414.000 dan klaim kematian palsu sebesar Rp 62.386.500.
“Jadi, total kerugian yang dibentuk terdakwa sebesar Rp 373.800.500. Ia didakwa sudah merugikan negara sebesar Rp 373.800.500, lantaran tidak pernah mengajar menjadi Guru SD Nomor 027144 pada Jalan Kueni Kelurahan Damai Kecamatan Binjai Utara selama 7 tahun dan menjamin kematian palsu,” terperinci Jaksa.
Perbuatan Demseria sebagaimana diatur & diancam pidana melanggar Pasal tiga jo Pasal 18 UU Nomor 31 Tahun 1999 sebagaimana sudah diubah dengan UU Nomor 20 Tahun 2001 Tentang Pemberantasan Tindak Pidana Korupsi.
“Terdakwa dapat didana penjara paling singkat 1 tahun dan paling usang 20 tahun dan atau denda paling sedikit Rp 50 juta dan paling poly Rp 1 miliar,” pungkas Asep.
Menanggapi dakwaan itu, terdakwa melalui penasehat hukumnya mengajukan eksepsi (nota keberatan).
Dalam eksepsinya, kuasa aturan terdakwa menyebut dakwaan JPU kabur dan tak jelas.
Tetapi, majelis hakim yang diketuai sang Nazar Efriandi menolak eksepsi tadi.
“Memerintahkan Jaksa Penuntut Umum buat menaruh verifikasi,” ucap hakim Nazar seraya mengetuk palu menutup sidang & melanjutkannya dalam minggu mendatang.

Demseria, Oknum Guru Pemalsu Kematian
Kasipidsus Kejari Binjai Asepte Gaulle Ginting sudah menjemputpaksa Demseria Simbolon, oknum guru berstatuf tersangka korupsi pengadaan/penerima gaji dan pensiunan kematian yang fiktif.
Demseria dijemput paksa usai pindah menurut Binjai semenjak 2011 ke Cikarang Jawa Barat.
Asepte menyebutkan Demseria Simbolon ditangkap di kediaman waktu bersama suami, anak, & kuasa hukumnya.
Demseria nir melawan waktu diciduk tim Kejari yg terbang menggunakan pesawat menuju ke Jabar.
“Dia kami amankan saat sedang beserta suaminya, anaknya, & kuasa hukumnya. Tidak ada perlawanan saat diamankan. Tim juga terdapat Herlina & Roy Tambunan” istilah Asepte di ruang Kajari Binjai Viktor Antonius, Rabu (7/11/2018)
Dijelaskan Asepte, yg didampingi Kasi Datun & Kasi Intel bahwa selama ini Demseria beberapa kali pernah pindah domisili.
Diperkirakan telah sejak 2011. Pihaknya belum mampu memaparkan aktivitas Demseria selama berpindah domisili.
Saat disinggung dugaan keterlibatan suami Demseria yg mengurus administrasi dan mencairkan dana pensiunan kematian pada PT Taspen, Asepte menyebutkan masih menyelidiki.
Pihaknya masih mengumpulkan bukti-bukti buat tetapkan suami Demseria menjadi tersangka baru dalam kasus ini.
Selanjutnya, dalam proses aturan, Demseria akan dioeriksa kesehatannya oleh tim medis buat dimintai informasi.
Demseria pula rencananya akan ditahan di Lapas Klas IIA Binjai.
“Rencananya beliau akan ditahan di Lapas Binjai apabila sudah siap diperiksa lanjut,” lata Kasi Datun, Nuni Triana.
Diketahui, perkara yg telah masuk termin penyidikan ini bermula berdasarkan seseorang oknum pengajar, DS yg bolos ngajar pada Sekolah Dasar Negeri 027144 semenjak 2010 lalu.
Meski bolos, honor yang bersangkutan tetap mengalir.
Besaran honor Demseria SSimbolon bervariasi, aporisma diperoleh Rp 4.367.900. Jika gaji yg bersangkutan dikalikan 86 bulan menjadi sebesar Rp 375.639.400.
Perbuatan ini bukan di ranah disiplin ASN lagi akar masalahnya.

Pura-pura Mati Selama 7 Tahun, Pengajar SD Ini Tak Pernah Mengajar & Terima Gaji Rp435 Juta
Namun terdapat upaya buat berafiliasi mendapatkan laba pribadi atau gerombolan yang merugikan negara.
Perkara ini diduga melibatkan Kepala Sekolah Dasar Negeri 027144 Binjai Utara Sulasih, Kepala UPT Disdik Binjai Utara Emi Sutrisnawati, Bendahara UPT Disdik Binjai Utara Irwan Khotib Harahap hingga Kabid Dikdas Disdik Binjai.
PT Taspen Medan, perusahaan plat merah ini mencairkan dana kematian DS yang diajukan suaminya, Adesman Sagala tahun 2014 kemudian. Padahal, Demseria belum wafat.
Diduga tanpa melakukan pengecekan seksama, PT Taspen mencairkan dana kematian DS yg penerimaan pertama pada 5 Mei 2014 kemudian sebanyak Rp 59.179.200 & penerima kedua sebanyak Rp 3.207.300 pada 23 November 2014.
Sehingga total dana kematian yang dicairkan PT Taspen itu sebanyak Rp 62.386.500 mengalir ke rekening Bank Rakyat Indonesia Pajak Tavip atas nama Adesman Sagala.
Total kerugian negara ditaksir mencapai Rp 438.025.900. Pencairan dana kematian yang disalurkan PT Taspen berkat adanya surat kematian yang dibuat Adesman Sagala.
Penyidik menduga, Adesman Sagala yg mengurus seluruh dokumen administrasi kematian fiktif tersebut yg kemudian diajukan pada PT Taspen.
